UNISON and UNITE: Local Government Workers - Strike Action
Local government workers, members of Unison and Unite, have been successfully balloted for strike action in response to the employers' "final offer" of 2.45% pay rise.
Many non-teaching staff may take official strike action on the day. There is likely to be dispruption across all local authorities on the 16/17 July.
NUT Advice to members is that they should not do any work that is normally done by members of Unite or Unison but they should undertake their normal work if their schools remain open. In abiding by such agreement it will be necessary to have regard to the need to ensure the health and safety of pupils. It is important that guidlines for adult:pupil ratios are properly observed during any days of industrial action.
Head teachers have a responsibility to carry out a risk assessment, under the Management of Health and Safety and Welfare Regulations 1999, and to put in place appropriate measures to remove or reduce those risks if it is decided to keep the school open. In schools, this duty falls to school managers and extends to risks to the health and safety of school students as well as employees. Risk assessments have to be reviewed whenever a significant change in circumstance occurs. This includes any occasion when non-teaching staff whose normal duties include supervision, security, cleaning etc. may be absent. Failure to carry out a risk assessment, identify appropriate measures which need to be taken to deal with any risks arising out the absence of such staff, and implement and record those measures in writing may affect the employer's legal liability or lead to problems with insurance policies.
Head teachers should carry out a risk assessment of the hazards which may be faced on 16/17 July. This assessment may lead to a decision to close the school. If it is decided to keep the school open then the head teacher should consider what measures may need to be taken to ensure reasonable safety.
The head teacher should also discuss the arrangements for the day with representatives of teaching staff, including NUT school representatives.
Any decision taken to close schools on 16/17 July should be made sufficiently in advance so that parents can be given adequate notice.
It is possible that schools may be picketed on the day of the strike. Pickets should not prevent members of the NUT from attending work if their schools are open. Members of the NUT have not been balloted for action on this day and any refusal on their part to cross picket lines would not be lawful action. The NUT would be legally required to repudiate it.
The purpose of any picket should not be to persuade NUT members not to enter school. Any such persuasion should be directed only at members of Unison and Unite taking lawful action on 16/17 July. Some pickets may simply want to inform you of why they are taking action. The NUT fully supports and has been at the forefront of the public sector pay campaign. School representatives should explain this advice to any pickets and explain that members of the NUT will not undertake work, which would have been carried out by members of other unions taking industrial action.

PAY CAMPAIGN and WORKLOAD
A further 15 MPs signed the Early Day Motion about Public Sector Pay following the Lobby of Parliament on 9th June. Surveys are taking place to gauge members thoughts and ideas about further industrial action. The July Executive will be discussing draft timetables for balloting for action in the Autumn term.

End Child Poverty: 'Keep the Promise Event' - 4th October 2008
The Government has committed itself to eradicating child poverty by 2020 and halving it by 2010. To hold the Government to their promise the campaign is calling on people to go to www.endchildpoverty.org.uk/promise where they can send a message to Gordon Brown to “keep the promise” and find out how else they can become involved.
All these public calls of support will be represented at what is planned to be the largest ever event to end child poverty, which will be held in Trafalgar Square on Saturday, 4 October 2008.
